By Downloading Visualax, using our Services, viewing Art and any content, you agree to all the Terms of Service. By installing, using or otherwise accessing the Service, you agree to these terms of service. If you do not agree to these terms of service, please do not install, use or other otherwise access the Service.

--Changes to Terms of Service—

We reserve the right to change any of the Terms of Service as our business needs evolve. We will make this apparent using an “Effective Date”. This way you will need to agree any updated “Terms of Service”.

--Conditions of Use--

1) Eligibility
This app is *not* suitable for children under 13 years old. You must be 18+ to purchase any subscription, Art, In-App Purchase or content. The applies to all countries where the app is being downloaded from or being hosted.

2) Illness and Offense
We don't take any responsibility for any form of illness or Offense, caused by to the use of Visualax and any content within their apps. Users must be aware of that computer graphics can cause seizures, eye strain, neck pain etc. Content addressing historical facts, character design, scene design, scene location and dialog can cause offense. Please read the description of content before watching or purchasing content.

3) General Usage
Visualax is designed to be used when sitting and chilling on your couch. Occasional standing is required.
Only use Visualax at home when sitting or standing.
Don’t walk, run or crawl when the app is being used. You can lock the phone when need to attend to something else
Don’t use Visualax when driving or during any form of work or duties.
Don’t use Visualax when in the front seat of a car.
We are not responsible for any form of injury or inconvience caused by the app, AR/VR/XR/MR headsets or mobiles devices.

4) Data Usage.
Visualax does requires an internet connection. Visualax can not be held responsible for any data charges during use or updating the app.

5) Subscriptions
Payment will be charged to iTunes/Appstore/Playstore/Any store Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period. You can manage or turn off auto-renew in your Account settings at any time after purchase No cancellation of the current subscription is allowed during the active period. However, you can cancel at anytime. You can still use Visualax even after cancelling, as long as the subscription has not expired.

Refunds: Your payment is managed by Apple via App Store or Google via Google Play and you will need to contact Apple or Google customer service for refunds, as we are not able to process refunds ourselves.

6) NFT Art
- If you are buying/viewing the NFT image, the 3D art may change to evolve with the hardware of the phone.
- We will constantly update the Art to be compatible with most modern phones.
- Background music can also change as this is controlled by Music License agreements.
- It’s not possible to upload 3D Realtime procedural programmatical art into a block chain or IPFS, hence only the image can be stored. While the 3D Art will evolve or sometimes, become incompatible. We recommend if the artwork is valuable, you should download it on a standalone device.

7) Updating or Removal of the app
We cannot be held responsible if the app is removed from the Appstore, Playstore or any other store for any type of reason. We cannot be held responsible for any failure to the Visualax app that an update will cause.

8) Classification
Visualax is not a Television or a Streaming service. Visualax is a Metaverse that uses a 3D Real-Time Engine.

9) Intellectual Property(IP), Trademarks and Licensing
All IP's and respective trademarks are own and Copyright protected by Visualax Ltd. All content is copyright protected. Permission is required by anyone recording, recreating or broadcasting content. Third Party license are used in Visualax content and we have permission to use content with purchase agreements and licensing by their respective owners.
- You are not permitted to extract Source code or copy content and art.
- You are not permitted to sell or distribute the app any other app stores or websites.
- You are not permitted to crack and tamper with the app in any form.
- You are not permitted to copy or sell the music, sound and graphics in the app.
